Pursuant to Article 13 of EU Regulation 679/2016 (GDPR), this document illustrates the methods and purposes of the processing of personal data that we receive and collect when the services/websites of Bellucci s.r.l. are used, as well as some of the measures we adopt to protect such data.

In compliance with applicable regulations, the processing carried out by Bellucci s.r.l. shall be based on the principles of lawfulness, fairness, transparency, purpose limitation and storage limitation, data minimization, accuracy, integrity, and confidentiality.

1 – Data Controller

2 – Personal data subject to processing

The processing of personal data means any operation or set of operations carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, comparison or interconnection, restriction, erasure, or destruction.

The personal data subject to processing, which may vary depending on the services requested, include: first and last name, email address, telephone number, tax code/VAT number, location data, an online identifier, purchases made, and other data suitable to identify or make the user identifiable (hereinafter “Personal Data”). In particular, the Personal Data processed through the Website are as follows:

a) Browsing data

When the user visits the Controller’s websites, the servers automatically record information such as URLs, IP addresses, browser type, browser language, date and time of the request. The transmission of this information is implicit in the use of web communication protocols.

This information is not collected to be associated with identified individuals, but by its very nature may, through processing and association with data held by third parties, allow users to be identified.

These data are used solely to obtain anonymous statistical information on website usage and to check its correct functioning. The data may be used to ascertain responsibility in the event of computer crimes against the website or third parties. Except for this possibility, such data are stored for 30 days.

b) Data voluntarily provided by the user

On the Controller’s websites, users may transmit their personal data by filling in forms or sending emails. The provision of such data is optional, explicit, and voluntary, and entails the subsequent acquisition of the sender’s email address, necessary to respond to requests, as well as any other personal data included for the purposes of the service and those further authorized by the user. Specific summary information notices are available on pages containing forms, with any indication of the mandatory nature of the data required to use the specific service.

The user assumes responsibility for any personal data of third parties published or shared through this website and guarantees that they have the right to communicate or disseminate such data, releasing the Controller from any liability towards third parties.

c) Data from interaction with social networks

In addition to filling out the registration form, users may be allowed to register for the Services, if they have a Facebook profile, by simply clicking the “Login with Facebook” button. In this case, Facebook will automatically send some personal data to the website, specified in the relevant pop-up window displayed at the time of the request, and no additional forms will need to be completed by the user.

Bellucci s.r.l. may use cookies, i.e. small files containing a string of characters that are sent to your computer when you visit a website, and other technologies to enhance your online experience and understand how Bellucci s.r.l.’s web services are used, in order to improve their quality. Under current Italian law, explicit user consent is not required for the use of certain cookies. In particular, “technical cookies” do not require consent, i.e. those used solely for transmitting a communication over an electronic communications network or strictly necessary to provide a service explicitly requested by the user. In other words, these are cookies essential for the operation of the website or necessary to perform activities requested by the user.

Registration on the website and the services offered are intended for adults only; therefore, the Controller does not knowingly collect data from persons under the age of 18.

The pages visited by the user may contain links to external websites to provide useful information. This privacy policy does not apply to websites not managed by the Controller; therefore, users should review the privacy protection procedures of those external websites.

3 – Purposes of processing

The processing of data, subject to specific consent where required by law, is carried out for the following purposes:

  • registering on the Controller’s websites;
  • using the services/products offered by the Controller;
  • monitoring, research, and analysis to manage and improve the Controller’s technologies and services;
  • responding to requests addressed to the Controller;
  • providing information on services/products offered by the Controller;
  • fulfilling pre-contractual, contractual, and tax obligations arising from existing relationships with the Controller.

Subject to specific and separate consent, personal data are also collected for:

  • sending newsletters, commercial communications, and/or advertising material relating to products and/or services offered by the Controller.

4 – Legal basis for processing

Bellucci s.r.l. processes the user’s personal data if one or more of the following conditions apply:

  • the user has given consent for one or more specific purposes;
  • processing is necessary for the performance of a contract or pre-contractual measures;
  • processing is necessary to comply with a legal obligation to which the Controller is subject;
  • processing is necessary for the legitimate interests of the Controller or third parties.

The data subject may request clarification of the specific legal basis for each processing activity.

5 – Optional or mandatory provision of personal data

The data subject is free to provide the requested personal data; failure to provide such data, or providing incomplete or inaccurate data, may make it impossible to use the requested services.

The acquisition of consent for the processing of personal data is necessary for all processing activities connected with or required to comply with legal obligations, EU regulations, contractual obligations, or specific requests made by the data subject prior to entering into a contract.

6 – Recipients of personal data

For the purposes described in Section 3 of this policy, the user’s personal data may be shared with:

  1. entities acting as data processors, such as individuals, companies, or professional firms providing accounting, administrative, legal, tax, or financial assistance to Bellucci s.r.l., as well as hosting providers and entities responsible for technical maintenance of servers;
  2. entities or authorities to whom disclosure is mandatory by law or by order of authorities;
  3. persons authorized by Bellucci s.r.l. to process personal data necessary to provide the Services, who are bound by confidentiality;
  4. commercial partners for their own independent purposes, only with specific user consent.

7 – Place of data processing

Personal data processing takes place at the premises of Bellucci s.r.l. and is carried out by technical, administrative, and commercial staff for the purposes described in Section 3.

Server providers are located within the European Union.

8 – Data retention

Personal data will be processed for the time necessary to achieve the purposes described in Section 3 or until consent is withdrawn.

Bellucci s.r.l. may retain personal data for the time permitted by Italian law to protect its interests. Further information regarding data retention periods and criteria may be requested from the Controller.

The websites of Bellucci s.r.l. adopt appropriate security measures to protect data against unauthorized access, alteration, disclosure, or destruction.

9 – Data subject rights

The user has the right to request access to their personal data, rectification, erasure, or objection to processing, as provided by Articles 18 and 20 of the GDPR, as well as data portability, by contacting Bellucci s.r.l. at the details provided above.

10 – Changes

The Controller reserves the right to amend or update this Privacy Policy at any time, including due to changes in applicable law, by notifying users on this page. Users are encouraged to review this page regularly. If changes are not accepted, registered users may delete their account or request the removal of their personal data.
